TRACK CRAFT END USER TERMS AND CONDITIONS OF USE
These terms and conditions of use, the Privacy Policy, and Cookie Policy (available at http://gamify.cz/privacy-policy), along with any additional terms (collectively referred to as the “Terms”), govern your use of Track Craft, an online and mobile racing game, including the website, app, and any related services or accounts required to access, install, or play the game (collectively referred to as "Track Craft").
Track Craft is provided by Brainz Gamify s.r.o., a limited company registered in the Czech Republic under registration number 09755578, with its registered address at Kaprova 42/14, Staré Město, 110 00 Praha Czech republic (“We”/“Us”/“Our”).
By accessing or installing any Track Craft services, you accept and agree to be bound by these license Terms. If you do not agree to these Terms, do not access or use Track Craft.
1. YOUR LEGAL OBLIGATIONS AND PROMISES TO US
1.1 Confirmation:You confirm that all information provided by you is true, accurate, and up-to-date. The rights granted under these Terms are personal to you, and you must not make Track Craft available to anyone else.
1.2 Compliance:You agree to comply with the Rules of Conduct and any other restrictions set out in these Terms.
1.3 Compensation:You agree to compensate us for any damages or expenses resulting from claims by third parties related to your use of Track Craft.
2. YOUR ACCOUNT/USE OF TRACK CRAFT
2.1 Account:Certain Track Craft services may require an account with the platform operator (e.g., Apple/Google). If needed, you must comply with the platform operator's terms.
2.2 Information Accuracy:If information provided in connection with your account is untrue or inaccurate, we reserve the right to refuse your use of Track Craft.
2.3 Account Security:You are responsible for the security of your account. Notify the platform operator immediately of any unauthorized use.
2.4 Content Removal:We reserve the right to remove content or Virtual Items at our discretion.
3. RULES OF CONDUCT AND YOUR USE OF TRACK CRAFT
3.1 Usage Restrictions:You agree not to use Track Craft for any purpose other than personal use. Additionally, you shall not reproduce, distribute, or attempt to access other users' accounts.
3.2 Inappropriate Behavior: You agree not to engage in behavior deemed inappropriate, harassing, threatening, or offensive. This includes not using offensive screen names or personas.
3.3 Monitoring:We reserve the right to monitor and record any online activity within Track Craft.
3.4 User-Generated Content:All User-Generated Content becomes our property, and we have the right to use it for any purpose without compensation to you.
3.5 Content Removal:We reserve the right to remove and permanently delete any User-Generated Content.
4. VIRTUAL ITEMS
4.1 Non-Refundable Purchases:All purchases made through Track Craft are non-refundable. You acknowledge that we are not required to provide a refund for any reason.
4.2 Licence for Virtual Items:By purchasing Virtual Items, you obtain a non-exclusive, non-transferable limited license to access such items for personal, non-commercial use.
4.3 No Ownership Rights:Virtual Items have no monetary value and cannot be sold or transferred. You have no ownership rights over Virtual Items.
4.4 Loss of Virtual Items:We are not responsible for the recovery or restoration of lost Virtual Items.
5. UPDATES
5.1 Automatic Updates:Track Craft may automatically download and install updates, upgrades, and additional features.
6. TERM PERIOD
6.1 Duration:These Terms apply from the date of downloading Track Craft and continue until you delete the game or either you cancel your account or we terminate this license.
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Ownership:All intellectual property rights in Track Craft belong to us, including content and Virtual Items. You are granted a limited license to use Track Craft under the terms of this agreement.
7.2 Use of Intellectual Property:Any use of our intellectual property must have prior express written authorization.
8. SUSPENSION AND TERMINATION
8.1 Grounds for Suspension or Termination:We reserve the right to suspend, restrict, or terminate your access to Track Craft if you breach any provisions in these Terms, for system maintenance, or if we decide to withdraw the game from the market.
9. LEGAL OBLIGATIONS AND LIMITS ON LIABILITY
9.1 Our Legal Duty:We are under a legal duty to ensure Track Craft complies with the contract between us. We will offer corrections or price reductions in case of non-compliance.
9.2 Right to Cancel:There is no right to cancel once you have installed Track Craft.
9.3 Liability Limitations:Our liability is limited except for cases of fraudulent misrepresentation, death, or personal injury.
10. DATA PROTECTION, SECURITY, AND PRIVACY
10.1 Privacy Policy:Refer to our Privacy Policy for information on data collection and privacy.
10.2 Cooperation with Authorities:We may cooperate with law enforcement authorities or court orders requiring disclosure of user information.
